PENDING LEGISLATION AND RELATED MATTERS
Expansion of the Michigan Consumer Protection Act (MCPA)
The Michigan House is considering HB 4915 which will greatly expand the reach of the MCPA by essentially eliminating the regulatory compliance exemption that exists in current law. Present law exempts from the Act, conduct authorized by a regulatory body of the state or federal government.
Physicians who are licensed by the MDCH do not fall under the MCPA because they are subject to licensing oversight by the MDCH. This bill would remove that exemption. If this bill were enacted it would mean that physicians would be subject to MDCH oversight as before but now also be subject to the provisions of the MCPA.
MOA has joined with dozens of other similarly impacted organizations to strongly oppose this bill.
Smoke-Free Workplace Legislation Passes Legislature
The Michigan Osteopathic Association is excited to announce that proponents of a bill that will ban smoking in workplaces, including bars and restaurants, has finally passed the Michigan Legislature. The bill is now on its way to the governor for singing. The bill will take effect May 1, 2010.
MOA worked diligently to get this important health issue passed. Thank you to our members who called, emailed and otherwise contacted legislators to urge passage of the bills.
